Welcome to Imaginati ("the App"). These Terms of Service ("Terms") govern your access to and use of our mobile application and services. Please read these Terms carefully before using the App.

By accessing or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the App.

1. Description of Service

Imaginati is a mobile application that allows users to:

• Generate images using artificial intelligence ("AI") based on text prompts.
• Edit user-uploaded images using AI-powered tools.

To use these features, users must purchase and spend in-app "Credits."

2. User Accounts

Imaginati uses an anonymous authentication system. You are not required to create an account with a username, email, or password. Instead, an anonymous, unique User ID is assigned to your device to manage your Credits and usage history. You are responsible for any activity associated with your anonymous User ID.

3. In-App Purchases and Credits

Credits: The App's features are accessed by using "Credits," which can be purchased within the App. All purchases are final and non-refundable.

Payment Processing: All in-app purchases are processed through third-party services like the Apple App Store or Google Play Store. We do not collect or store any of your payment information. You are subject to the terms and conditions of the respective app store.

No Monetary Value: Credits are not currency and have no monetary value outside of the Imaginati app. They cannot be sold, transferred, or exchanged for cash. Unused Credits will not be refunded upon termination of service or if you cease to use the App.

4. User Conduct and Acceptable Use

You agree not to use the App to create, upload, or share any content that:

• Is unlawful, harmful, threatening, abusive, defamatory, obscene, or hateful.
• Promotes discrimination, bigotry, racism, hatred, harassment, or harm against any individual or group.
• Is sexually explicit, pornographic, or contains nudity.
• Depicts gratuitous violence or illegal acts.
• Infringes upon any third party's intellectual property rights, including copyright, trademark, patent, or trade secret.
• Violates the privacy or publicity rights of any third party. This includes generating images of identifiable people without their consent.
• Attempts to create or disseminate misinformation or "deepfakes" for malicious purposes.

We reserve the right, but are not obligated, to remove any content and/or terminate a user's access for violating these terms, without a refund of any purchased Credits.

5. Content Ownership and Rights

Your Content: You retain ownership of the original images you upload for editing ("User Content").

Generated Content: You own the rights to the unique AI-generated images you create using the App ("Generated Content"), subject to the terms and conditions of our underlying AI service providers (e.g., fal.ai). The use of AI-generated content may be subject to open-source or other licenses from our technology partners. We make no claim of ownership over your Generated Content.

Our License to You: We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

Your License to Us: In order to provide the service, you grant Imaginati a limited, worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your User Content and Generated Content solely for the purpose of operating and providing the App's services to you. For image editing, this includes temporarily storing your uploaded image on our secure cloud service (Supabase) before it is permanently deleted after processing, as described in our Privacy Policy.

6. Third-Party Services

Our service relies on third-party providers, including fal.ai for AI processing, Supabase for temporary storage, and RevenueCat for purchase management. Your use of the App is also subject to the terms and privacy policies of these providers. We are not responsible for the practices of these third-party services.

7. Termination

You can stop using our App at any time. We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including for a breach of these Terms. Upon termination, your right to use the App and any remaining Credits will be forfeited.

8. Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE" without any warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or secure. The output from our AI services may be unexpected, and we make no guarantees as to the accuracy, quality, or suitability of the Generated Content.

9. Limitation of Liability

To the fullest extent permitted by law, Imaginati and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the App.

10. Changes to These Terms

We may modify these Terms from time to time. We will notify you of any changes by posting the new Terms within the App and updating the "Last Updated" date. Your continued use of the App after the changes become effective constitutes your acceptance of the new Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Turkey, without regard to its conflict of law provisions.
